Under Ontario’s Dog Owner’s Liability Act, the liability of the owner is not dependent on knowledge of the propensity of the  dog. In addition, the dog owner will be liable for the damages caused by their dog, even if there was no fault or negligence on the part of the owner.  As such, even if the dog behaved out of character by attacking, the owner will still be liable for the injuries caused by the dog.
